Critical Disclaimer: This calculator provides rough estimates for educational purposes only using simplified formulas. Actual spousal support (alimony) varies dramatically by state (New York), with some states using formulas and others using factor-based approaches. Courts consider numerous factors including earning capacity, standard of living, contributions to marriage, age, health, and more. These calculations do NOT constitute legal advice. Consult with a family law attorney in New York for accurate analysis of your specific situation.

New York Spousal Maintenance

New York uses a formula for both temporary and post-divorce maintenance, up to an income cap of $241,000 (effective March 1, 2026). Income above the cap is considered at the judge's discretion.

Guideline Amount

When the payer is not also paying child support: (1) 30% of the payer's income minus 20% of the recipient's income; (2) 40% of combined income minus the recipient's income. The lower result applies. When the payer also pays child support, the first calculation uses 20% of the payer's income minus 25% of the recipient's income.

Advisory Duration

Up to 15 years of marriage: 15–30% of the marriage length. 15–20 years: 30–40%. Over 20 years: 35–50%. These durations are advisory.

Tax

Post-2018 maintenance is not deductible or taxable on the federal return, but New York did not adopt that change: maintenance can still be deductible by the payer and taxable to the recipient on the New York return. A tax professional can confirm how it applies to you.

Cost

Divorce.com packages start at $499 in most states; court filing fees are separate.
